In short
- You keep ownership of your content; MyRhythm only gets the licence needed to host and show it to the audience you chose.
- Public publication and marketing use of a minor's content are separate permissions — never bundled into these Terms.
- Anyone who can lawfully view content may still copy it; we safeguard, but cannot guarantee against redistribution.
- Accounts can be restricted or closed for conduct that puts a minor at risk.
About MyRhythm
MyRhythm is a digital performing arts platform designed to help performers create profiles, share performances and creative works, receive feedback, participate in events and competitions, and connect with appropriate members of the performing arts community.
The Platform may allow users to upload, store, stream and share photographs, videos, audio recordings, creative works and related information.
Acceptance
By creating an account, accessing the Platform, uploading Content or participating in a MyRhythm event, you agree to these Terms.
Where the User is a Minor, the Terms must be accepted and authorised by a parent, legal guardian or other person legally authorised to act on the Minor's behalf where required by applicable law. The Minor may also be asked to provide age-appropriate acknowledgement or assent.
Minors and parent/guardian responsibility
A Minor means a person under 18 years of age for MyRhythm's default product rules, subject to mandatory law in a particular jurisdiction.
Where a Minor uses MyRhythm, the responsible adult confirms that:
- they have the legal authority to act for the Minor;
- information supplied about the Minor is accurate;
- they have reviewed the Privacy Policy, Parental Consent Notice and Parent Guide;
- they have explained relevant Platform use to the Minor in an age-appropriate manner;
- they understand that photographs, videos and audio may identify the Minor; and
- they understand that online Content may be copied, recorded or redistributed by third parties.
Personal information
MyRhythm may process information reasonably necessary to provide the Platform, including names, display names, age/date of birth, contact information, event participation, adjudication and feedback, photographs, videos, audio/voice, creative works, support correspondence and technical information.
The Privacy Policy explains the relevant purposes, lawful bases or other authorisations, recipients, retention and rights.
Child personal information
MyRhythm treats information relating to Minors as requiring enhanced protection. Where applicable law requires consent from a parent, legal guardian or competent person, MyRhythm will obtain and record that consent.
MyRhythm will not rely on blanket Terms acceptance as a substitute for specific consent where separate consent is required.
User Content
“Content” includes photographs, videos, audio, performances, artwork, writing, comments, profiles, feedback and other submitted material.
The person submitting Content remains responsible for having the necessary rights and permissions.
Do not upload Content that infringes another person's rights, is unlawful, abusive, threatening, discriminatory, sexualises or exploits a Minor, discloses unnecessary private information, facilitates grooming, or otherwise breaches these Terms or applicable law.
Rights granted to MyRhythm
You retain ownership of your Content unless you expressly agree otherwise. By uploading Content, you grant MyRhythm the limited, non-exclusive, worldwide, royalty-free licence reasonably necessary to host, store, process, transcode, stream and display the Content to provide the selected service.
Separate public-publication or marketing permissions govern those optional uses where required by law.
Public and promotional use of Minor Content
Public publication and marketing use of a Minor's image, video, voice or creative work are separate permissions where required. MyRhythm will not treat optional marketing consent as automatically included in acceptance of these Terms.
Online publication risk
Once Content is legitimately visible to another person, that person may potentially screen-record it, take screenshots, save it, share it or redistribute it elsewhere. MyRhythm will use reasonable technical and organisational safeguards but cannot guarantee that Content will never be copied or redistributed.
Account security
Users must protect authentication information and promptly report suspected unauthorised access. MyRhythm may require mobile-number verification and other security measures.
Mobile verification
MyRhythm may verify a mobile number by one-time code sent through WhatsApp or SMS. Codes are short-lived, single-use and rate-limited. Mobile verification verifies control of the mobile channel; it is not by itself proof of parental authority.
Child safety
Users must not solicit inappropriate private contact with a Minor, request sexualised or exploitative material, pressure a Minor to disclose private information, attempt inappropriate off-platform contact, or groom, threaten or harass another person.
MyRhythm may restrict accounts, remove Content, preserve information and report to appropriate authorities where required or permitted.
Moderation
MyRhythm may use human and automated moderation mechanisms to investigate reports, enforce these Terms, protect users and comply with law.
Suspension and termination
MyRhythm may suspend or terminate accounts for material breaches, legal requirements, serious safety/security risk, abusive or exploitative conduct, discontinuation of the service or other lawful grounds.
Withdrawal and removal
A Parent/Guardian may withdraw optional consent and exercise applicable privacy rights in accordance with the Privacy Policy. Withdrawal does not invalidate prior lawful processing. MyRhythm cannot guarantee removal of independent third-party copies.
Availability and disclaimer
The Platform is provided on an “as available” basis. MyRhythm does not guarantee uninterrupted availability or that third parties will always act lawfully.
Limitation of liability
To the maximum extent permitted by applicable law, MyRhythm will not be liable for losses arising solely from a User's failure to secure credentials, unnecessary information voluntarily disclosed, unauthorised third-party copying after lawful access, third-party services outside MyRhythm's control, or events outside reasonable control.
Nothing excludes liability that cannot lawfully be excluded or limited. Any limitation, indemnity or assumption of risk is subject to applicable consumer-protection and other mandatory law.
Indemnity
To the maximum extent permitted by law, the User and Parent/Guardian agree to indemnify MyRhythm against third-party claims arising directly from false or unauthorised representation of authority, unlawful or infringing Content, breach of these Terms, or expressly authorised instructions.
This does not apply to the extent a claim is caused by MyRhythm's own unlawful processing, fraud, wilful misconduct or non-excludable liability.
Changes
MyRhythm may update these Terms. Where changes materially affect a Minor's rights or obligations, MyRhythm will provide appropriate notice and obtain renewed consent where legally required.
Governing law
These Terms are governed by South African law, subject to mandatory law applicable to a User in another jurisdiction. Mandatory consumer and data-protection rights are not excluded.
